This presentation will be an overview of the legal aspects and preventative staffing measures one can take to attempt to avoid unionization. The Democrats are in control of Congress and the White House and the passage of the EFCA is a major focus. The EFCA makes union organizing as simple as signing a card. Plus, the penalties for an employer who fights unionization are steep. In addition, the EFCA allows outside arbitrators to determine wages, benefits and more for employees. Employers need to take action now to prepare for a union onslaught.
From a staffing strategy standpoint, the use of contingent, temporary, and contract labor is expected to continue increasing in coming years.
